THE UNCONSTITUTIONAL PRACTICES OF THE IRS (Part 1)
10-20-2010 9:50 pm - Scott Killough
In the coming weeks I will be writing a series of articles on taxation, in order to help the reader understand and then make his/her own decisions about the issues that are involved. I will tell you from the outset that, having studied the Constitution, the case law and the evidence I have at hand, I can reach no other reasonable conclusion than this: the income that you get from your daily job, your personal earnings and wages, whether you currently work at a high or low paying job, is yours to keep. The personal earnings that you get from the sweat and blood and tears that you put in daily is YOURS, and you have a right to it. According to the Supreme Court, (see Tom Cryer Memorandum) your personal earnings and wages are untaxable income. In fact, there is no law making the average person’s personal earnings subject to taxation.
Well, you may say, anyone can say anything, but where is your proof.
Exactly! I should give you proof. In fact, I have the proof, and I will be giving you that proof over the coming weeks. I will be breaking it down into sections, so that each part of the proof is as clear as a bell to anyone who reads these articles.

Perhaps there are a very few of you who might say, what difference does this proof make to me?

Simply put, the Supreme Court ruled that there is no law ___________. That means you are supposed to have the Constitutional right to work for a living and to keep what you earn. If you invest your money and make gains on that money, you may (or may not) owe income taxes, depending on the circumstances). But the money you receive as your paycheck is yours, and you have a Constitutional right to it. Any adult person who is working and been paying taxes to the IRS has been gulled into believing that they must pay taxes on “everything that comes in”. The Supreme Court found that practice by the IRS unconstitutional.

The scope, breadth and depth of what I am talking about is so incredible that some of you will dismiss what I am about to tell you without reading any further. Perhaps you know people who have lost their homes, cars, businesses, etc…, to the IRS for failure to pay taxes. Although I can’t make a global sweeping statement about every single one of those cases, I can tell you that the IRS practice is unconstitutional, and you need to understand what that means for you, for your family, for your paycheck and for your friends and neighbors.

Therefore, it is my purpose to convey to all who read this article, the impact of the recent ruling by the Supreme Court on this matter. If you want to go to the website (http://www.gcstation.net/liefreezone/THEMEMORANDUM.pdf) and read the Tom Cryer Memorandum (which completely outlines this case), please feel free to do so. If the intricacies of law are not your forte, then I believe you will profit from my efforts to break this Memorandum down into understandable bites and to present it in such a way that it is clear, compelling and readable for everyone.

We all owe a great debt of gratitude to Tom Cryer for his willingness to stand up to the IRS, and to take this issue to the Supreme Court. The ruling they made impacts us all. I believe that every one of us is obligated to understand this ruling and to choose what they are willing to do to stop continued unconstitutional behavior by the IRS.

In the next article, I will start with the very first section. Week by week, I will walk you through each section. When you arrive at the end of the Memorandum, you will surely be clear about the issues involved in taxation, and you will be educated enough to make your own decision about what to do.

Personally, I believe that, once every single adult in this country refuses to pay unconstitutionally assessed and collected taxes, then the IRS will be forced out of business. I personally believe the IRS practices are founded on greed. Our ignorance of the abuse of our rights, has led our country into the era of greed and corruption we have all been suffering from these many years.

IF you believe in the power of the Constitution, and, IF you believe that you are entitled to unabridged Constitutional rights, then every person of every race, color and religious belief should unite in stopping the IRS from continuing this abusive practice.

Please note that Mr. Cryer begins his Memorandum with a caveat, which I will include here. CAVEAT:

THIS MEMORANDUM WAS PREPARED AND WRITTEN FOR ONE SPECIFIC CASE AND MAY NOT APPLY TO OTHERS. IT IS NOT OFFERED AS LEGAL ADVICE NOR AS A LEGAL OPINION RELATIVE TO ANYONE OTHER THAN THE PARTY IN THIS CASE AND FOR THE ISSUES PRESENTED BY THIS PARTICULAR PROCEEDING.
